These Terms govern your use of our website, nomination system, Proud Cards, Proud of You Wall, Shop, contribution features and other services. By using the website or submitting content, you agree to these Terms.
1. Who We Are
The Proud of You Project is operated by the legal entity identified in our website settings and policies. POY is not currently represented as a 501(c)(3) charitable organization. The legal entity/status shown on the website should be updated only after formation/compliance details are confirmed.
2. Eligibility
You must be legally capable of agreeing to these Terms to submit purchases or financial contributions. Nominee eligibility is governed by the nomination rules displayed on the website. Nominees currently must be at least 16 years old and live in the United States. Nationwide U.S. nominations are accepted, while the Project’s earliest Pack activity is focused in Florida as it grows. If a nominee is 16 or 17, parent or legal guardian permission is required before Honoree participation or public recognition.
3. Nominations
Submitting a nomination does not guarantee selection, create a right to receive a Pack, payment, product, service or recognition, automatically make the nomination public, or create an employment, agency or contractual relationship with POY. Nominators must provide information they reasonably believe is truthful. Self-nominations are not currently accepted unless POY changes this rule. An active nomination may be considered for up to six months after submission without monthly resubmission. A previous Honoree is not eligible to be selected again until 12 months after the prior Honoree date. POY may determine eligibility and selection in its discretion consistent with its published program rules.
4. Honoree Participation
If someone is selected, POY may contact them for additional information and permission. A selected person may decline. POY will not intentionally publish a declined nomination simply because it was submitted. Separate releases or permissions may apply to photographs, stories, likenesses, interviews or other public Honoree materials.
5. Proud Cards
Proud Cards are intended for genuine positive communication. You may not use Proud Cards to harass, threaten, impersonate, intimidate, stalk, spam, defraud, distribute unlawful content, or evade another person’s request for no contact. POY may limit, block, review, disable or remove Cards that violate these Terms or create safety/security concerns.
6. Proud Card Replies
POY may provide private reply functionality. POY does not guarantee that a sender or recipient will respond. Users may not use replies for harassment, spam or prohibited conduct. POY may disable a conversation where necessary.
7. Proud of You Wall
Wall submissions may be public. Only content intentionally submitted or opted into public display should appear on the Wall. POY may moderate, edit formatting, refuse, remove or hide Wall content when reasonably necessary.
8. Your Content
You retain ownership of original content you submit. You grant POY a limited, non-exclusive license to host, process, reproduce and display that content as reasonably necessary to provide the feature you requested. For content intentionally submitted for public display, that permission includes displaying the content through POY websites and related POY channels. Public Honoree stories, commercial campaigns or broader promotional use may require separate permission where appropriate.
9. Prohibited Use
You may not interfere with website security; scrape private information; access private Cards without permission; attempt unauthorized access; submit malicious code; use automated systems to spam forms; impersonate others; submit knowingly false or defamatory content; violate intellectual property rights; or use the website for unlawful purposes.
10. Shop
Shop purchases are subject to the prices, product information and policies presented at checkout. Shipping and returns are governed by our Shipping & Returns Policy.
11. Contributions
POY may accept voluntary financial support. Unless expressly stated otherwise, contributions are unrestricted; POY may use them to support the Project’s programs and operations; contributions are not earmarked for a particular individual solely because that individual or program is referenced; and POY may reallocate funds as needs and circumstances change. POY is not currently represented as a qualified 501(c)(3) charitable organization. See the Donation Policy for important tax and refund information.
12. Intellectual Property
POY branding, logos, designs, site content, software and other materials owned by POY may not be copied or used without permission except as allowed by law.
13. Third-Party Links
POY may link to third-party websites. We do not control their content, availability or policies.
14. No Guarantee
The website and services are provided on an “as available” basis. We do not guarantee that the website will always be uninterrupted, every nomination will be reviewed on a particular date, anyone will be selected, any particular Partner will participate, or any particular Pack item will be available.
15. Limitation of Liability
To the maximum extent permitted by applicable law, POY is not responsible for indirect, incidental or consequential losses arising solely from use of the website or inability to access it. Nothing in these Terms limits rights or liabilities that cannot legally be limited.
16. Termination
POY may restrict access to features when reasonably necessary for security, abuse prevention, legal compliance or violations of these Terms.
17. Governing Law
These Terms are governed by applicable United States law and the laws of the State of Florida, without overriding consumer protections that legally apply.
18. Changes
We may update these Terms as the Project evolves. Continued use after an update is subject to the revised Terms.
